Notification obligations
In various areas, the Austrian Telecommunications Act 2003 (TKG 2003) imposes obligations on businesses which operate in the field of electronic communications.
Notification of services: Art. 15 TKG 2003 stipulates that the regulatory authority must be notified of the operation/provision of public communications networks and services.
Similarly, Art. 25 Par. 1 requires that general terms and conditions as well as conditions regarding rates and charges be reported to the regulatory authority. The regulatory authority has the right to raise objections in cases where such terms and conditions do not comply with the Austrian Telecommunications Act, the General Civil Code or the Consumer Protection Act.
Additional notification obligations apply in the field of numbering, where the provisions of the Communications Parameters, Fees and Value-Added Services Ordinance (KEM-V) specifically require notifications regarding allocated telephone numbers in use.
