Overview of the market analysis procedures to be carried out regularly under Art. 37 TKG 2003
The tables below show the current market analysis procedures which the Telekom-Control Commission has to carry out regularly under Art. 37 TKG 2003 for sector-specific ex ante regulation.
The Austrian regulatory authority divides the ex ante markets defined in the Telecommunications Markets Ordinance (TKMVO) into clusters (groups). The basis for this clustering approach was the "old" ONP framework, which differentiated a "fixed-link cluster“ (with retail and wholesale markets), a "mobile cluster" (with wholesale markets only), a "leased line cluster" (with a retail market and wholesale markets), a "fixed-link data cluster" (with wholesale markets only) and a "broadcasting cluster" (with wholesale markets only). For the sake of completeness, we would also like to point out that – regardless of its how they are defined – these clusters have no legal significance. The obligations which have to be imposed (where appropriate) once market analysis is completed always refer to each individual market, regardless of its cluster classification.
