In a decision issued on December 9, 2008, the Telekom-Control Commission issued a partial interconnection order for mobilkom Austria AG in response to a request submitted by Hutchison 3G Austria GmbH pursuant to Art. 50 Austrian Telecommunications Act (TKG) 2003 with regard to the fees for origination in each respective operator's mobile network. In light of the fact that no company possesses significant market power pursuant to Articles 35 and 37 TKG 2003 in the market for mobile origination services, the fees concerned in the dispute were to be set at an "appropriate" level. Among other factors, the criteria for setting such appropriate fees were the actual underlying costs as well as the fees customary on the market.
The following fees were set for the service of mobile origination:
Hutchison:
June 1, 2005 – December 31, 2008: 19.62 euro cents
From January 1, 2009 onward: 9.5 euro cents
mobilkom:
June 1, 2005 – December 31, 2008: 10.28 euro cents
From January 1, 2009 onward: 9.5 euro cents
