3.2.3 Licensing procedure for regional private television

At the same time as the applications for a nationwide licence for analogue terrestrial television were received, 20 applications for regional licences from different applicants were submitted to KommAustria within the specified time.

For the conurbation area of Vienna the following applicants applied:

  • n-tv Nachrichtenfernsehen GmbH & Co KG together with Karl Ulrich Kuhlo as well as Dr. Helmut Brandstätter and Mag. Michael Grabner

  • KANAL 1 Fernsehbetriebsgesellschaft m.b.H.
  • Puls City TV Rundfunkveranstaltungs GmbH
  • Ganymedia Network GmbH
  • Smart.city.TV Fernseh- u. Rundfunk GmbH i.G.

For the conurbation area of Linz and the Federal Province of Upper Austria the following applicants applied:

For the Federal Province of Carinthia the following applicants applied:

  • Ganymedia Network GmbH
  • KT 1 Privatfernseh GmbH for Central Carinthia
For transmission capacities in the Federal Province of Tyrol the following applicants applied:
  • Ganymedia Network GmbH
  • LFT Lokalfernsehen Tirol GmbH & Co KG

In addition, Ganymedia Network GmbH also applied for all transmission capacities listed in Annex 1 to the PrTV-G.

Pursuant to § 4 KOG, the applications for the issuing of licences for analogue terrestrial television were submitted to the Broadcasting Advisory Board.

On 13.11.2001, pursuant to § 4 (7) PrTV-G, KommAustria submitted the applications for the issuing of regional licences for analogue terrestrial television to the respective Provincial Governments for comment.

Since § 16 (2) PrTV-G, as mentioned before, explicitly provides for the possibility of applying for regional licences, using the transmission capacities of Annex 1 to the PrTV-G or of the ORF (§ 13 PrTV-G), applicants involved in the procedure for the issuing of licences for regional television will know for sure, only after the licence for nationwide television has been issued with legally binding effect, which transmission capacities will be actually used for nationwide television and which are therefore still available for regional licences. The procedure for the award of licences for regional television was continued in 2002 and concluded in summer 2002.
