LTE expansion can now begin: VwGH rejects petitions by Hutchison and T-Mobile

The Austrian Administrative Court (VwGH) today rejected the petition filed by T-Mobile, requesting suspension of enforcement of the administrative decision, issued by the Telekom-Control-Kommission, on the multiband auction. A similar petition by Hutchison had already been rejected last week, so that no further barriers to rapid expansion of LTE in Austria now exist. It is pleasing to note that the VwGH clearly rejected the argument put forth by T-Mobile that LTE expansion was not in the vital public interest.

Payment of the auction revenues to the federal government is due by today. The VwGH has yet to hand down a ruling on the actual complaints. It is reported that parties also intend to file complaints with the Constitutional Court.
