Frequency allocation of 800/900/1800 MHz bands (2013) – Announcement regarding prohibition of collusion
In the light of recent events, the Telekom-Control-Commission (TKK) decided on 4 March 2013 to publish an announcement on the general prohibition of collusion in spectrum auctions, specifically the frequency allocation procedure for the 800/900/1800 MHz bands.
In connection with the pending procedure for assigning the frequency ranges of 800 MHz, 900 MHz and 1800 MHz, the regulatory authority explicitly emphasises that, irrespective of the fact that the tender documentation has not yet been published, detailed and strict regulations concerning collusive behaviour apply. The following actions in particular constitute collusive behaviour:
- any cooperation of applicants and/or potential applicants, particularly with the intention of influencing the course or result of the auction;
- making public any information concerning the participation in the auction;
- making public bid amounts or bidding strategies;
- spreading any hints, indications or rumours via the media in the run-up to an auction.
These provisions already apply to the period prior to the auction procedure. Any behaviour in breach of these regulations may ultimately result in exclusion from the procedure.
